Requirements for a Will

You should make a Will to ensure that your assets will be distributed to the people you love and cherish.

A will is the most important document you will ever sign. It ensures your estate is disposed of in accordance with your wishes, ensures loved ones, especially elderly spouses, young children and other dependents are taken care of and achieves tax minimization objectives. A will is the central element of your estate planning strategy.

What are the requirements for a Will in Singapore?

For your Will to be valid in Singapore:

  • You must be at least 21 years old.
  • The will must be in writing, either handwritten or printed.
  • You must sign at the end of the will.
  • The will must be witnessed.


  • 2 witnesses must be present while you are making your will.
  • Neither of the witnesses can be your spouse or a beneficiary under your will.
  • Your witnesses must be mentally sound.
  • Each witness must also sign the will in the presence of each other.

You must possess the requisite testamentary capacity:

  • You must understand the will you are making and its consequences
  • You must know the extent of the property which you are including in your will.
  • You must know who your beneficiaries are and understand what you are giving to them under your will.
  • You must not be mentally unsound (e.g. suffering from delusions) that might impair your feelings or judgments when you make your Will.
  • You must have known of and approved of the contents of the will.
  • You must not have made the will as a result of undue influence (i.e. pressure that has overpowered your freedom of action without your actually having been convinced) or fraud.
